Medical Professional Liability Insurance for
Individual Physicians and Small Physician Groups

Overview

Stuff happens. It’s not always possible, despite one’s best efforts, to maintain a pristine claim history. In today’s medical malpractice environment, physicians who have experienced some losses over time have had little choice but to seek coverage from insurance companies that serve the "distressed physicians" market. Too often, such coverage is overly punitive and does not accurately reflect a physician's true experience.

At Darwin, we recognize that medical malpractice insurance should not be an “either/or” proposition where physicians are categorized as either perfect or poor risks. There should be a middle ground that recognizes the reality of the industry and rewards good physicians for their continued efforts to provide quality care. And there is, at Darwin.

Insurance is evolving. Darwin is leading the way.

Darwin’s health care team has been immersed in the health and managed care environment since the early 1980s. It’s a legacy we are proud of, but more importantly, it serves as the foundation that supports our commitment to the health care industry.

  • Our resources are an extension of our customers’ efforts to manage risk.
  • We understand and appreciate the nuances of local medical delivery systems.
  • The entire team is personally invested in the business of health care and we move with agility to respond to emerging exposures.

With a dedicated health care underwriting practice, Darwin has built an infrastructure that demonstrates commitment at every touch point—from risk assessment and coverage terms to claims administration and risk management services. Our focus is on serving the distinct needs of each health care customer. And we do so with talented people who offer a broad range of capabilities.

Financial Stability: Darwin’s claims-paying ability is backed by the stability of Alleghany Insurance Holdings LLC, a subsidiary of Alleghany Corporation (NYSE ticker symbol, Y).

Risk Management Expertise: Darwin’s commitment to our policyholders extends beyond simply providing an insurance policy. From weekly newsletters to annual CME credits, our risk management support helps mitigate potential loss and reinforces the central role each member of your group plays in managing risk.

Expert Claims Handling: Darwin has a dedicated medical professional claims department staffed with medical malpractice experts. Our claim professionals have well-earned reputations for fairness and responsiveness. At Darwin, gathering input on claims involves more than simply the economic value of the case.

Competitive Rates: Darwin’s underwriting flexibility gives physicians coverage options and price based on risk exposure – not market perception. Our rates are more attractive than the rates charged by more restrictive surplus lines programs.

Experienced Agents: We have partnered with insurance professionals who have years of experience with medical malpractice insurance. Darwin’s agency partners have demonstrated commitment to supporting the insurance and loss control needs of physicians.

Preferred Segments

Darwin’s medical professional liability coverage is available for individual physicians and small physician groups with less than 10 physicians. Coverage is currently available in Connecticut and New Jersey only.

Some specialties are ineligible for coverage, including emergency room physicians, radiologists, pathologists, neurologists, and high-risk obstetricians.

Capacity

$1 million per medical incident/$3 million aggregate ($4 million aggregate in Connecticut) limit available per physician or mid-level provider, as well as separately for the corporation where employed ancillary medical professionals are covered.

Coverage Highlights

For qualifying physicians, Darwin offers broader terms of coverage than traditional surplus lines markets allow, including:

  • Claims-made coverage, “incident trigger” reporting of claims available
  • First dollar coverage (deductible options where applicable)
  • Prior Acts coverage
  • Unlimited Extended Reported Period endorsement available at policy termination for an additional premium. Premium will be waived in event of death, disability, or retirement.
  • Defense costs covered. Defense outside the limits of liability available.
